Acceptance and scope

By using this website, submitting a request, accepting a confirmed rental or service, paying an invoice, or using an authorized dispatch account, you agree to these Terms and Conditions. Rental-specific rules shown and acknowledged during booking are part of these terms and apply to the relevant dumpster or equipment rental.

If a written estimate, invoice, or separately signed agreement conflicts with these general terms, the more specific document controls for that service.

Eligibility and accurate information

You must be at least 18 years old and legally able to enter an agreement. You agree to provide accurate contact, job-site, rental, and billing information and to promptly correct material changes. If you submit a request for a company or another person, you represent that you are authorized to do so.

Requests, estimates, and confirmation

An online submission is a request, not an automatic reservation or guarantee of availability, delivery, price, or service. A rental or service becomes confirmed only after Kennedy & Sons expressly confirms the schedule, items, location, price, and any required payment arrangements.

Cleanout, demolition, concrete, and other project inquiries are requests for review. Scope, price, timing, disposal needs, permits, and site requirements may be confirmed in a separate estimate or agreement.

Pricing, discounts, and extra charges

Website totals are based on the selected items, quantities, dates, and eligible promo codes. Kennedy & Sons will confirm the price before the request becomes a confirmed rental. We may correct obvious pricing, availability, or product-description errors before confirmation.

Depending on the rental and circumstances, additional charges may apply for extra rental days, excess weight, prohibited or special materials, overloaded containers, failed delivery or pickup caused by site conditions, fuel, cleaning, missing accessories, loss, theft, misuse, preventable damage, or other items disclosed in the rental terms or confirmed agreement. Any additional charge must identify its amount and reason.

Invoices and payment

Payment is due according to the applicable invoice or confirmed agreement. Kennedy & Sons may require a deposit or partial payment before delivery when that requirement is communicated to the customer. Invoices and payment links may be provided through Intuit QuickBooks.

Contact us promptly if you believe an invoice or additional charge is incorrect. Failure to make an agreed payment may delay or cancel undelivered service and may result in lawful collection of amounts due.

Cancellation, rescheduling, and refunds

You may withdraw an unconfirmed online request at any time by calling or emailing us, and no website cancellation fee applies. For a confirmed rental or service, contact us as soon as possible to cancel or reschedule.

If equipment has already been dispatched or delivered, work has begun, or Kennedy & Sons has incurred a cost that was disclosed to you, you remain responsible for the applicable delivery, return-trip, rental, disposal, labor, or other incurred charge. Amounts paid for unperformed services will be refunded unless a different non-refundable amount was clearly disclosed and accepted before payment. Refunds are returned through the original payment method when practical. This policy does not limit rights that cannot be waived under applicable law.

Delivery, pickup, and job-site access

You are responsible for providing a lawful, safe, accessible, and suitable delivery or work area; obtaining any permits or property-owner approvals; identifying hidden hazards and underground systems; and giving accurate access instructions. Kennedy & Sons may refuse or postpone service when a site is unsafe, inaccessible, restricted, or likely to damage property or equipment.

Site-specific risks, including pavement, lawns, curbs, fences, plantings, wells, septic systems, sprinklers, and underground utilities, remain subject to the rental rules acknowledged during booking and applicable law.

Dumpster use

Dumpsters may be used only for approved materials and may not be loaded above the top wall. Hazardous materials and other prohibited items listed in the booking terms are not allowed without prior written approval. Only Kennedy & Sons may move a delivered container. The customer is responsible for unauthorized use, prohibited contents, overloading, and damage caused by others while the container is in the customer's care.

Equipment use and care

Equipment must be used safely, legally, by qualified persons, and only for its intended purpose. The customer is responsible for ordinary care, secure storage, fuel and cleaning when applicable, and returning all items and accessories in substantially the same condition, normal wear excepted.

Report a breakdown, accident, theft, unsafe condition, or material damage promptly. Do not continue operating equipment that appears unsafe or damaged.

Condition records and inspections

Kennedy & Sons may inspect and photograph rental items and surrounding placement conditions at delivery and pickup. These records may be used to document service, item condition, damage, prohibited loads, extra charges, or disputes.

Electronic communications

By providing an email address or phone number for a request, you agree that Kennedy & Sons may use it for transactional communications about that request, including scheduling, status, invoices, and payment. Standard carrier charges may apply to calls or texts. You may request a paper copy of an electronic record by contacting us.

Authorized dispatch accounts

The dispatch and administration areas are for authorized Kennedy & Sons users only. Users must protect sign-in information, use the tools only for legitimate company operations, and promptly report suspected unauthorized access. Kennedy & Sons may suspend or revoke access at any time.

Acceptable website use

You may not bypass access controls, interfere with the website or API, introduce malicious code, scrape or obtain another person's information, impersonate another person, submit fraudulent requests, or use the service for unlawful activity.

Third-party services

The website may link to or integrate with services such as QuickBooks, mapping providers, email providers, and push-notification platforms. Their terms and privacy policies govern their services. Kennedy & Sons is not responsible for a third party's independent systems, content, or availability.

Website availability and disclaimers

We work to keep website descriptions, pricing, availability, and tools accurate, but the website may occasionally contain errors or be unavailable. Online content is provided for general information and request preparation and does not replace a confirmed estimate, invoice, rental agreement, operating manual, permit requirement, or site-specific safety instruction.

To the fullest extent permitted by law, the website and dispatch tools are provided on an "as available" basis without a promise of uninterrupted or error-free operation. Nothing in these terms excludes a warranty or consumer right that cannot legally be excluded.

Limitation of liability

To the fullest extent permitted by law, Kennedy & Sons is not liable for indirect, incidental, special, or consequential losses caused solely by use of, or inability to use, the website or dispatch tools. Liability relating to an actual rental, delivery, pickup, or other service is governed by the confirmed agreement, the acknowledged rental rules, the facts of the service, and applicable law.

Events outside reasonable control

Kennedy & Sons is not responsible for delay or failure caused by severe weather, unsafe conditions, road closures, equipment failure despite reasonable maintenance, utility or network outages, government action, labor disruption, or other events outside reasonable control. We will make reasonable efforts to communicate and reschedule affected service.

Privacy

Our Privacy Policy explains how information submitted through the website and dispatch tools is collected, used, shared, protected, and retained.

Changes to these terms

We may update these terms as services, pricing practices, providers, or legal obligations change. The version in effect when a rental or service is confirmed generally applies to that transaction unless the parties agree otherwise or law requires a change.

Governing law and severability

Massachusetts law governs these terms, without overriding consumer protections that apply under other law. If a provision is found unenforceable, the remaining provisions continue to apply. A failure to enforce a provision once is not a waiver of the right to enforce it later.
